UPS supplied freight charge to supplier in UK with no exclusions stated against the freight charge. Upon delivery to Philippines, delivery is held for four days without telling me why.
Finally UPS Philippines says I have to pay import tax & duty. They state that as this is not specifically included in the invoice then it is payable. Contract law states that anything that is not specifically excluded but is a normal part of a process (i.e. taxes and duties on an imported delivery) can legally be assumed to be included.
Confirmed with the shipper that they assume the same.
UPS Philippines is now holding parcel hostage and have phoned my wife threatening legal action unless she pays the charges. Luckily I'm in the Philippines tomorrow to start legal proceedings against them
